NOTICE OF PUBLIC HEARING

RESOLUTION AND ORDER for Legal Notice of Public Hearing to

Receive Comment on the Formation of the Town of Lima Water District No. 4

 pursuant to New York State Town Law

 

WHEREAS, the Town Board of the Town of Lima desires under Article 12-A of the New York State Town Law to create the Town of Lima Water District No. 4, which would include certain real property located wholly in the Town of Lima, County of Livingston and State of New York; and

 

WHEREAS, the Town requested that the Town Engineer produce a Map, Plan and Report to provide the details of the water district boundaries and improvements to take place within the Town of Lima Water District No. 4; and

 

WHEREAS, the Town Engineer has caused such Map, Plan and Report to be prepared and delivered to the Town Board and the Town Clerk of the Town of Lima; and

 

WHEREAS, the real property that will be located in the district is described in the Map, Plan and Report attached hereto and filed in the Lima Town Clerk’s Office and is more particularly described as follows:

 

All that tract or account of land situate in the Town of Lima, Livingston County, State of New York, being described as follows:

 

Beginning at a point on a westerly line of the existing Village of Lima water district and a westerly Village of Lima Municipal Line, 3,133 feet, more or less, northerly of the center line of West Main Road (99 feet wide right-of-way); thence,

 

1. Westerly, along the easterly extension of a southerly line of tax account number 36.-2-11.481 and a

southerly line of tax account number 36.-2-11.481, a distance of 200 feet, more or less, to an easterly

line of said tax account number; thence,

 

2. Southerly, along an easterly line of tax account number 36.-2-11.481, a distance of 270 feet, more

or less, to a southerly line of said tax account number; thence,

 

3. Westerly, along a southerly line of tax account number 36.-2-11.481, a distance of 1,225 feet, more

or less, to the southwesterly corner of said tax account number; thence,

 

4. Northerly, along the westerly line of tax account numbers 36.-2-11.481, a distance of 868 feet, more

or less, to the northwesterly corner of said tax account number; thence,

 

5. Easterly, along a northerly line of tax account number 36.-2-11.481, a distance of 1,256 feet, more

or less, to a northeasterly corner of said tax account number; thence,

 

6. Southerly, along an easterly line of tax account number 36.-2-11.481, a distance of 319 feet, more

or less, to a northerly line of said tax account number; thence,

 

7. Easterly, along a northerly line of tax account number 36.-2-11.481, and the easterly extension of a

northerly line of tax account number 36.-2-11.481, a distance of 200 feet, more or less, to a westerly

line of the existing Village of Lima water district and a westerly Village of Lima Municipal Line;

thence,

 

8. Southerly, along a westerly line of the existing Village of Lima water district and a westerly Village

of Lima Municipal Line, a distance of 60 feet, more or less, to the easterly extension of a southerly

line of tax account number 36.-2-11.481; thence,

 

9. Westerly, along an easterly extension of the southerly line of tax account number 36.-2-11.481, and

a southerly line of tax account number 36.-2-11.481, a distance of 200 feet, more or less, to an

easterly line of said tax account number; thence,

 

10. Southerly, along an easterly line of tax account number 36.-2-11.481, a distance of 115 feet, more

or less, to a northerly line of said tax account number; thence,

 

11. Easterly, along a northerly line of tax account number 36.-2-11.481 and the easterly extension of a

northerly line of tax account number 36.-2-11.481, a distance of 200 feet, more or less, to a westerly

line of the existing Village of Lima water district and a westerly Village of Lima Municipal Line;

thence,

 

12. Southerly, along a westerly line of the existing Village of Lima water district and a westerly Village

of Lima Municipal Line, a distance of 30 feet, more or less, to an easterly extension of a southerly

line of tax account number 36.-2-11.481 and the point of beginning.

 

Proposed Water District, as described above, contains approximately 23.7 acres of land.

 

All as shown on a map prepared by Clark Patterson Lee, entitled “Proposed Water District”, dated October 12, 2018.

 

NOW THEREFORE BE IT ORDERED and RESOLVED, that the Map, Plan and Report for the Town of Lima Water District No. 4 as prepared by Clark Patterson Lee last dated June, 2020 is hereby acknowledged as received by the Lima Town Board and shall be filed in the Lima Town Clerk’s Office; and be it further

 

RESOLVED, that pursuant to New York State Town Law, a public hearing be held on the 6th day of October 2020 at 6:00 p.m. at the Lima Town Hall at 7329 East Main Street, Lima, New York, with respect to the formation of the Town of Lima Water District No. 4 to include the property noted and as more particularly described in the Map, Plan and Report filed in the Lima Town Clerk’s Office; and be it further

           

RESOLVED, that the Map, Plan and Report calls for the installation of water delivery infrastructure to service eight (8) homes within the Salerno Subdivision Tupelo Trail; and be it further

 

RESOLVED, that the cost for the water delivery improvements that will serve the proposed Town of Lima Water District No. 4 will be entirely borne by the developer of the Salerno Subdivision Tupelo Trail as part of the development cost of such project; and be it further

 

            RESOLVED, that the anticipated cost to the typical property located within the Town of lima Water District No. 4 is estimated to be $575.00, which includes no debt service for the costs associated with the improvements, but rather is comprised of quarterly water charges of $45.00 per quarter for ($180.00 annually), plus estimated annual water costs of $394.20 (estimated based on historical usage of single-family residential units within the Town of approximately 180 gallons per day); and be it further

 

            RESOLVED, that the cost associated with connecting the individual  homes within the proposed Town of Lima Water District No. 4 has been paid for by the developer of the Salerno Subdivision Tupelo Trail and shall not result in additional charges to the benefitted properties within said District; and be it further

           

            RESOLVED, that a copy of the Map, Plan and Report describing the proposed district formation shall be available for the public inspection at the Lima Town Clerk’s Office; and be it further

 

            RESOLVED, that at the time and date aforementioned, all interested parties may be heard concerning the formation of the proposed Town of Lima Water District No. 4.

 

The question of the adoption of the foregoing Resolution was duly submitted for approval by vote of the Lima Town Board on Tuesday, September 1, 2020, recorded as follows:

NOTICE IS HEREBY GIVEN, the Lima Town Board will hold a public hearing on the fiscal year 2021 Preliminary Budget at a regularly scheduled meeting October 6, 2020 at 6:00 PM at the Lima Town Hall.  A Copy of the 2021 Preliminary Budget is available for inspection in the Town Clerk’s Office during regular business hours.  It is also available online at www.lima-ny.org

The schedule of salaries for elected Town officials is as follows:

Town Council 4 @ $4,362.25

Town Supervisor $15,478.00

Town Justices 2 @ $11,231.50

Highway Superintendent $72,778.00
